How old are you? A. Seventeen years is about my age. Q. What kin are you to Randolph McCoy? A. He is my Grandfather. Q. Were you at his house at the time Alifair McCoy was killed? A. Yes sir. Q. Now Melvin, do you know how old you were at the time? A. Six years was about my age Q. Now tell the Jury if you remember what occurred; tell what occurred in your own way? A. On New Year's 1888 (Counsel for defendant objects to the introduction of the witness, on the grounds that he was of such a tender age at the time of the killing that he is incompetent - overruled, and the defendant excepts) or about that time, the Hatfields come to my grandfather's house, and surrounded the house. The first words I remember was they said "God Dam you we have got you. We are going to take you to Logan County, you shant be hurt". Then they fired into the house and shot a right smart through the house, then you know one of my aunts Alifair McCoy came and told them not to burn the house down, and they shot her down. Then from that time you know the house was burned, and we all left the house. Q. Now Melvin, which room was you in? A. With my grandfather. Q. Who else was in the room with you? A. One of my Uncles, Calvin. Q. Who else? A. My grandma. Q. Who was in the other room? A. One of my aunts that was killed and another one of my aunts. Q. Which room was the fire set to? A. The one my grandfather was in. Q. Do you know who went out of the house first? A. My uncle and grandmother, grandmother first. Q. Who went next? A. My Uncle Calvin went next. Q. Who went next? A. Grandfather. Q. Who went next? A. They told me to come in the house where grandma was, I turned and went and got my clothes, and went back in the room where they were. Q. What did you discover? A. I saw a man. Q. Did you know any of the parties? A. No sir, I did not. Q. Did you see your aunt? A. Yes sir. Q. Where was she? A. Laying there dead in the door or near the door. Q. What was her name? A. Alifair McCoy. Q. Did you examine her? A. No sir, I did not. Q. At the time you found her laying in the door, was the house on fire? A. Yes sir. Q. Where did Calvin go, and did you see him anymore? A. Not until the next morning and we found him dead. Q. When you went into the house did you see your grandmother? A. No sir, not until we got into the other room. Q. You found her then? A. Yes sir. Q. Did you find that your grandfather gone out? A. Yes sir. Q. Did you see your grandmother any more that night? A. Yes sir, I stayed with her all the time. Q. Was there anything that was to matter with your grandmother? A. Yes Sir, she had been struck with something on the head. Johnson Hatfield struck her with a Winchester. Q. Did the house burn down? A. Yes sir. Q. Where did you go? A. Up the branch from the house. Q. Who went with you? A. My two aunts and myself dragged my dead aunt up there. Q. How far from the burning building did you get? A. Two or three hundred yards. Q. Did you have any fire? A. No sir. Q. What kind of night was it? A. Cold. Q. How cold? A. It was freezing cold. Q. Was the ground frozen up? A. Yes sir. Q. Where did you stay the rest of the night? A. Up the branch until daylight. Q. How many up there was there? A. My grandma, two aunts, little sister and myself and my dead aunt. Q. How far was Calvin away from you all? A. I do not know how far it was - three or four hundred yards I guess. Q. Did you lay Calvin on anything? A. No sir, we did not know he was killed until next morning. Q. Was your aunt that got killed dressed or in her night clothes? A. She had her clothes on. Q. How was your grandmother dressed? A. I do not remember. Q. Was your sister dressed? A. I think she had her clothes on. Q. Did you examine your dead aunt to see if she had any wounds? A. Yes sir. Q. Did she have any wounds? A. She was shot through the left breast. Q. How long had you been acquainted with her? A. She raised me. Q. Do you remember who come there the next morning first? A. Yes sir, but I have forgotten who it was. Q. What did you do with the sled? A. They hauled my grandmother and my dead aunt in it. Q. What was the matter with your grandmother (defendant objects - overruled and the defendant excepts) A. She was hit in the head with a pistol and over the back with a gun; her ribs were broken on one side. Q. Was she in unconscious condition? A. Yes sir.   Cross examined by Mr. Harkins Q. You say Mr. McCoy that you were then six years old when that occurred. A. Yes sir. Q. I will ask you if you heard them say the words you have repeated? A. That is all I heard them say. Q. Were you in the same room with your grandfather? A. Yes sir. Q. Did you see but the one man you have mentioned? A. No sir, I did not. Q. Have you been living with your grandfather since that time? A. Yes. Q. During that time have you frequently talked about what occurred there that night? A. Yes sir. Q. Very often? A. Not a great deal. Q. Have you heard it talked some? A. Yes sir. Q. You say your grandmother was hit on the head with a pistol and over the back with a gun? A. Yes sir that is what she said he did. I do not know only what she said. I do not know that myself. Q.
